Renovation work and consequences of changes to premises

In a renovation dispute, it is useful to distinguish the timing of noisy work from possible consequences of changes to the premises. The first concerns specific incidents. The second may involve the construction of floors, partitions, building services assemblies or sound transmission conditions after renovation is complete. These circumstances are substantiated by different materials.

For individual incidents, retain the dates, duration and nature of the work heard, information about complaints and investigation results. If the problem remained after the renovation ended, describe how the current sound differs from the previous sound and when the change was first noticed. A “before” and “after” comparison requires a clear timeframe.

  1. Prepare a chronology of the start of work, complaints and changes in the nature of the noise.
  2. Attach available notices, correspondence and responses from the property management organisation.
  3. Identify rooms and areas where the impact is apparent.
  4. Separate questions about work times from questions about the technical condition of structures.

Requesting renovation documents does not replace an inspection of the actual condition, and the absence of a document does not in itself establish the cause of sound transmission. If a specialised investigation is required, first formulate a specific question: which properties of the structure need to be checked and what materials are available for that purpose.

In a legal position, it is useful to link the claim to an established circumstance: cessation of specific actions, inspection of the actual condition or rectification of a confirmed violation. Different aims may require different actions and the involvement of different people. The lawyer assesses this from the documents and circumstances of the case, maintaining the distinction between legal conclusions and technical questions.

Enquiry

Describe the noise and attach evidence

The lawyer will assess where to complain, what evidence is needed, whether a lawsuit has prospects and what remedies can be sought: stopping the noise, remedying the violation, and recovering compensation for non-pecuniary harm and costs.

  • neighbour noise, renovation, music, stomping, tenants;
  • complaints to the police, ОАТИ, Rospotrebnadzor and the property management company;
  • drafting formal demands, lawsuits and motions;
  • legal support during expert examinations and noise measurements;
  • representation in court.

Up to 10 files of 10 MB each. Retain the original recordings; arrange submission of large materials separately.

How data is processed: Personal Data Processing Policy. Attach only materials relevant to the noise; redact unnecessary data about other people.

Dates and times of noise, videos, complaints to the police/ОАТИ/Rospotrebnadzor and responses from the authorities are useful for an initial assessment.

Attachments: up to 10 files of up to 10 MB each, with a maximum combined size of 15 MB. If a file is rejected, the enquiry is not sent.
